Welcome to ClamQuest, LLC (“we,” “our,” or “us”). Please read these Terms of Use (“Terms”) carefully before accessing or using our StaffAway mobile application, website (www.clamquest.com or www.clamquest.app), or related services (collectively, the “Services”). By using or accessing the Services, you agree to be legally bound by these Terms and all applicable laws.
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, please do not use the Services.
StaffAway is intended for users aged 13 and older. Users under 18 must have parental or guardian approval to use the Services. We do not knowingly collect personal information from children under 13. Parents and guardians are encouraged to supervise their child’s use of the Services.
You may use the Services solely for your personal, non-commercial purposes and in compliance with these Terms and all applicable laws. You agree not to:
Violate any laws or regulations;
Upload or distribute viruses, malware, or harmful content;
Infringe intellectual property or privacy rights;
Use the Services for unauthorized commercial purposes;
Impersonate others or engage in abusive or harassing behavior;
Interfere with or disrupt the operation of the Services.
If you create an account or login credentials to access certain features, you are responsible for maintaining the confidentiality of your account and all activities under it. Notify us immediately of any unauthorized use. Account sharing is limited to authorized users within your organization.
Your use of the Services is subject to our Privacy Policy, which explains how we handle your data. StaffAway does not collect, transmit, or share your data externally. All data is stored locally on your device. Any data shared externally happens only when initiated by you, such as exporting reports or sending emails.
Employers may archive employee records, which removes employees from the active list but retains their data until permanently deleted. Employers can delete PTO data starting from any specified date to maintain accurate records.
The Services allow exporting and importing of payroll and PTO data to facilitate management across devices and platforms. Any sharing of this data is initiated by the user and not controlled by us.
We may suspend or terminate your access to the Services at any time, without notice or liability, for any reason including violation of these Terms.
The Services are provided “as is,” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We are not liable for any damages arising from your use of the Services, including errors, interruptions, or third-party content. Some jurisdictions may not allow limitations on liability, so this may not apply to you.
You agree to indemnify and hold harmless ClamQuest, LLC, its affiliates, officers, and employees from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services.
The Services may contain links or integrations with third-party services. We do not control or endorse third-party content or practices and disclaim liability related to those services.
We may update these Terms at any time by posting the revised version with a new effective date on our website or within the app. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts located in Florida.
